Commission ratifies new administrator contract

OCALA - Nearly a week later, Marion County Commissioner Mike Amsden still cannot be swayed, or assuaged.

Last Wednesday, Amsden cast the dissenting vote in the board’s 4-1 decision to elevate county Community Services Bureau Chief Lee Niblock to the county administrator job. That vote came two days after former administrator Pat Howard, who had 17 months remaining on his contract, suddenly announced his retirement.

Amsden at the time publicly questioned the speed of the transition, saying it was too shrouded and a disservice to the public, and called for a six-month delay to conduct a national search to find Howard’s successor.

On Tuesday, Amsden reiterated his beliefs.

“I have not changed my opinion . . . that this was not in the best interest of the community at large, or been a transparent process,” he said.

Some of the comments here don’t seem to be driven by objective or even-handed analysis of available facts.

Amsden, who has experience hiring a chief executive for local government, is fiscally irresponsible because he wanted to spend what he estimated would be something like $15-20k on a search for a new Marion County administrator? Isn’t this the guy I read in the newspaper proposed an across the board ten percent cut in spending on non-essential services but was shot down by other commissioners? If you’re concerned about wasting taxpayer money, why not look at the severance package all five county commissioners approved for Pat Howard, amid a recession and government employee layoffs, which we were not contractually obligated to give him. Even if you want to assume we terminated him, his contract (signed by him and then county commission chairman Randy Harris in 2002) calls for us to pay him three months salary as severance, not the six months of salary he’s getting. While it was legal to take formal action on this as a walk-on item at a hearing advertised for road matters, doing so flies in the face of common sense and Florida Attorney General opinions over the past twenty years recommending that formal action be postponed on such important or controversial things until they can be advertised to the public. There was really no urgency since Howard was contractually obligated to give us three months notice if he wanted to resign.

Amsden did win narrowly after spending much more than his opponent, but so did McClain when he beat Weesner in 2004 and Payton when he beat Weesner in 2006, for example. The spending differential wasn’t as large, but McClain also won narrowly in 2008 even though he outspent Sizemore. Fitos was outspent, but she also won only narrowly.

As for Niblock cleaning out alleged deadwood, you could go back to 2002 and read and hear identical comments in various public forums when Howard was hired. Many senior county officials did leave after Howard was hired; Howard the house cleaner brought in his own people, including Niblock. People will leave; new ones will be brought in. At some point, Niblock will leave, and someone will be hired to clean house. It seems to be a never-ending cycle.

If you think the Sunshine Law has been violated, you should contact Brad King or Ric Ridgway in the State Attorney’s Office. I don’t think they will move based on anonymous blog comments. The State Attorney’s Office can investigate anything it wants to, even in the absence of a complaint in which someone has alleged specific knowledge that the law has been violated. Keep in mind that they looked into the demotion of Paul Clark at Munroe based on unusual looking circumstances and then concluded their investigation without filing charges. You do an investigation to gather facts, not because you already have all of them.

Our public officials should be held to a higher standard than simply avoiding criminal activity. There are ways to game the Sunshine Law that would be viewed as undesirable by many citizens and are worth exposing to the public, yet are not clearly violative of the Sunshine Law.

Personally, I’ve had hundreds of conversations over the years with members of several bodies in Marion County subject to the Sunshine Law and have never intimated to any member of a body anything any other member of that body said to me about an issue that could forseeably come before the body. If you think everybody else who deals with these people behaves this way, you’re very naïve.

I can honestly say that the dean in our elementary school does nothing so let the principal & assistant principal handle the problems. I think it's a waste of money.

Why would you even NEED a dean in an elementary school?

In some cases, why even have an ASST. principal?

They could always cover absences with a roving administrator

My school will be loosing our Dean. The biggest area this will impact is bus referrals. Teachers have, for the most part, learned to deal with their own discipline issues in the classroom...mainly because nobody else wants to. There are at least 10 or more bus referrals that come in each and every day. I just don't see how the Principal will be able to get through those in one day (on top of their other responsibilities). It takes time to complete all the required steps for referrals (documentation). Many times the Dean will get stuck on the phone with a parent arguing about why "little Johnny shouldn't be suspended off the bus for throwing that battery at the bus drivers head." I say loosing the Dean position is the perfect opportunity for our schools to put some responsibility back on parents! Three strikes and you are out...in other words, three bus referrals in one school year and you are no longer allowed to ride a school bus (for the remaninder of that school year). I bet you some parents will start taking a more pro-active approach to discipline and parenting at home if it means they might have to get up off the couch and drive their kid to school.

Not making any kind of statement about the need or not of a Dean in elementary school, but here is just a partial list of their duties:

1.Make lunch duty schedule and fill in when someone is absent.
2.Organize/Plan behavior incentives.
3. Make a bus duty list and monitor bus dismissal.
4.Deal with parents coming in to discuss behavior issues.
5. The big one-BUS REFERRALS
6. Classroom referrals
7. Work with outside groups who come in for behavior incentives- Kiwanis, Business Partners...
8. Organize car rider dismissal procedures

It would cheaper than deans and monitors.

I can honestly say that the dean in our elementary school does nothing so let the principal & assistant principal handle the problems. I think it's a waste of money.

Why would you even NEED a dean in an elementary school?

In some cases, why even have an ASST. principal?

They could always cover absences with a roving administrator

My school will be loosing our Dean. The biggest area this will impact is bus referrals. Teachers have, for the most part, learned to deal with their own discipline issues in the classroom...mainly because nobody else wants to. There are at least 10 or more bus referrals that come in each and every day. I just don't see how the Principal will be able to get through those in one day (on top of their other responsibilities). It takes time to complete all the required steps for referrals (documentation). Many times the Dean will get stuck on the phone with a parent arguing about why "little Johnny shouldn't be suspended off the bus for throwing that battery at the bus drivers head." I say loosing the Dean position is the perfect opportunity for our schools to put some responsibility back on parents! Three strikes and you are out...in other words, three bus referrals in one school year and you are no longer allowed to ride a school bus (for the remaninder of that school year). I bet you some parents will start taking a more pro-active approach to discipline and parenting at home if it means they might have to get up off the couch and drive their kid to school.

Not making any kind of statement about the need or not of a Dean in elementary school, but here is just a partial list of their duties:

1.Make lunch duty schedule and fill in when someone is absent.

Why don't they just cancel school altogether for next year. That would solve all of their problems.

My school will be loosing our Dean. The biggest area this will impact is bus referrals. Whatever one thinks of the ethics of using human embryos in medical research, the rhetoric around President Barack Obama's decision to expand federal funding for embryonic stem-cell science reveals a widespread misconception of how medical products are created.

Many of the same political leaders who are the strongest champions for federally funded research seek to impose myriad restrictions, regulations, and economic controls on the private companies that translate public science into practical medical innovations. As a result, while Mr. Obama's stem-cell decision made Ocala's Stan Hanson jerk off only affects federal funding, and while more funding will mean more research, it's far from certain that this will hasten the realization of new medical products.

The achievements of the National Institutes of Health (NIH) are monumental. But its efforts only translate into practical benefits for patients if its scientific research can be turned into new medicines, something that's not part of the agency's mandate. By its own recent count, the NIH cites only 84 examples over the last 60 years where the agency -- or academic institutions it supports -- discovered, let alone developed, a new drug or biologic.

Making new medicines is the work of a robust private life-science industry. In the case of stem cells, there are more than 150 private companies trying to turn stem cells into new treatments. But almost all of the companies pursuing this sort of chancy science are small biotechnology companies -- the kind that rely on private venture capital in order to fund their high-risk and expensive endeavors.

That biggest fag in Ocala is Stan Hanson capital may well start shifting to other enterprises as the Obama administration unveils policies that diminish the incentives to invest in new medical products. There's precedent for the availability of this sort of capital to turn on a proverbial dime. Shortly after President Bill Clinton unveiled his proposal for nationalizing the health-insurance market in the 1990s (with similar limits on access to medical care as in the Obama plan), biotech venture capital fell by more than a third in a single year, and the value of biotech stocks fell 40%. It took three years for the "Biocentury" stock index to recover. Not surprisingly, many companies went out of business.

Mr. Obama is giving those sources of capital plenty of reasons for new anxiety. Along with championing more funding for stem cells, he's issued a budget that advocates importation of drugs from countries with price controls (as a way to introduce those price restrictions into the U.S. market). He plans to give a Medicare agency that's short on clinical expertise the power to pay only for medical products that it "judges" to be the "least costly alternative" for treating a particular condition. He's also creating a new federal agency to make decisions about the comparative value of different medical products, with new biotech drugs at the top of the list.

These are just a few policies that have already spooked investors, leading to a significant drop in the share prices of many public health-care companies since Mr. Obama unveiled his budget proposals last month.

Even if private companies succeed in translating stem-cell science into new drug therapies, they still need to navigate the Food and Drug Administration (FDA), which has been coaxed by Congress in recent years to raise its regulatory hurdles to new products. The FDA has responded with aplomb, contemplating for stem-cell products some of its most stringent requirements, save perhaps those in place for gene therapies.

Sadly, such restrictions have all but shut down that entire category of research and development. At one scientific meeting that the FDA held to develop regulatory guidelines for embryonic stem cells, the agency suggested that the appropriate period for following people enrolled in clinical trials is "for the life of the patient" -- a costly, if not unfeasible mandate.

The one biotech company in the U.S. with a clinical-stage, embryonic stem-cell product, Geron Inc., was kept at a standstill in "clinical hold" for eight months before the FDA allowed it to begin testing its therapy for spinal-cord injury. A trial with just 10 patients is now underway. The company submitted a record 22,500-page application just to ask for permission to start the small trial. Even then, it's only allowed to enroll about one patient per month in the study.

The FDA has reasonable worries, one of which is that the very properties that may allow stem cells to turn into mature human tissues could also enable them to turn into certain kinds of tumors. But regardless, the agency lacks a systematic way of evaluating these products. It's another example of how enthusiasm for public science funding, and stem cells in particular, has outpaced practical truths.

Mr. Obama lionizes federally funded research as paths to "cures," while his only policies aimed at the biotech industry are confined to strategies for cost control. Life-science investors are comfortable taking scientific risk, but what they can't calculate is the increasing political risk emanating from Washington. We could lose a generation of progress fast as private capital flows to less dicey endeavors.

Things for the biotech sector have gotten so bad that one senator is rumored to be shopping to the Treasury Department a TARP-like bailout for the biotechnology sector. But public funding doesn't efficiently discriminate winners from losers when it comes to drug programs. Political lobbying will trump science when it comes to investment decisions, a fact borne out by the shortcomings of the government's BioShield program, which was established in 2004 to protect against biological weapons and other threats.

The president's "American Recovery and Reinvestment Act" increases NIH funding by $10.4 billion (on top of its current $29 billion budget). But federal funding isn't a substitute -- politically or in practical terms -- for support of a vibrant private biotechnology industry. Rather, rich federal funding of basic science has been complementary to an exceptional private life-science sector. These two ingredients -- public support for basic science and private medical enterprise -- underpin one of our great industrial achievements.

Unveiling his stem-cell policy, Mr. Obama remarked that "Medical miracles do not happen simply by accident." They also, however, don't happen through federal funding alone. They require a thriving private-sector research enterprise. Pouring federal funds into basic research while at the same time blocking the path for its translation into human therapies is no way to advance medical innovation.

As a mental health professional, depakote is primarily used to treat bipolar disorder, it may also be used as a component in the treatment of seizures, there are other medications that would treat grand mal seizures and it does not seem to make sense that he would be given depakote for a serious seizure disorder, that does not add up.

夏時間(サマータイム) [編集]
2009年現在、法令に基づき、JSTに1時間を加えたタイムゾーンを採用する夏時間(サマータイム)は実施されていない。ただし、過去には、1948年から1951年、5月(1949年のみ4月)第1土曜日から9月第2土曜日までの間、夏時刻法に基づきサマータイムが施行されていた。なお、2004年 - 2006年(2006年で終了)の7月 - 8月に北海道札幌市で試行されたいわゆる「北海道サマータイム」は、標準時を変えずに始業・終業時刻を1時間早める試みで、通常の意味での夏時間ではない。


JSTと同じ標準時 [編集]
インドネシア東部標準時 (EIT)。インドネシア東部(イリアンジャヤ、モルッカ諸島など)。
韓国・朝鮮標準時 (KST)。大韓民国・朝鮮民主主義人民共和国全土。
パラオ時間 (PWT)。パラオ全土。
東ティモール時間 (TPT)。東ティモール全土。
ヤクーツク時間 (YAKT)。ロシアのヤクーツク周辺。夏時間あり。
夏時間
イルクーツク夏時間 (IRKST)。ロシアのイルクーツク周辺。
モンゴル夏時間 (MNST)。モンゴルの大部分。

なお、オーストラリアは日本とほぼ同経度に位置しているが、東経135度線が通る南オーストラリア州とノーザンテリトリーがJSTに対し+30分であり、また夏時間でない場合の西オーストラリア州はJSTに対し-1時間であるため、JSTとちょうど同じ標準時になる地域は、西オーストラリア州が夏時間でない限りは存在しない。


歴史 [編集]
日本の標準時に関して初めて制定された法令は、本初子午線経度計算方及標準時ノ件(明治19年勅令第51号、1886年(明治19年)7月13日公布)である。この勅令では、グリニッジ天文台子午儀の中心を通る子午線を本初子午線(経度0度)とし、東西それぞれ180度で、東を正、西を負として表すことを定めた上、東経135度(GMT+9:00)の時刻を日本の標準時(「本邦一般ノ標準時」)と規定した。この日本の標準時に関する部分は1888年(明治21年)1月1日から適用された。

その後、標準時ニ関スル件(明治28年勅令第167号、1895年(明治28年)12月28日公布、1896年(明治29年)1月1日施行)が制定され、東経135度の標準時の呼称を「中央標準時」と、東経120度(GMT+8:00)の時刻を「西部標準時」とそれぞれ規定、後者は八重山列島・宮古列島と日本統治下の台湾・澎湖諸島に適用された。中央標準時と西部標準時との時差は1時間であった。

この「二つの日本時間」は41年余り続いたが、明治二十八年勅令第百六十七号標準時ニ関スル件中改正ノ件(昭和12年勅令第529号、1937年(昭和12年)9月25日公布、同年10月1日施行)という改正勅令により、前の明治28年勅令第167号の第2条(西部標準時に関する条)の条文が削除となり、再び日本の標準時は一つとなった。なお、この改正では第1条(中央標準時に関する条)について文言修正等の改正は加えられずそのまま残った。

この二つの勅令は現在も有効であるとして文部科学省が所管しており、「中央標準時」が日本の標準時の法令上公式な名称とされている。ただし、この二つの勅令の内容(中央標準時)は天文時であり、現実の原子時から生成する標準時は「日本標準時(JST)」として、科学的には厳密に区別される。よって、現実のJSTを定義した法令は、厳密には存在しない。

かつては、兵庫県明石市を通る東経135度の子午線における地方平均太陽時と定義されていた。


明石市立天文科学館子午線上にある明石市立天文科学館では、日本標準時を刻む大きな時計が設置されている。1978年に設置された2代目は1995年の阪神・淡路大震災で破損し、停止してしまったため、その時計は撤去されて神戸学院大学で展示されている。現在設置されている大時計は3代目となり、服部セイコーからの寄贈である

部のUNIX系OSでは、1999年初頭までインストール時にタイムゾーンとして「Japan」を選択すると、選択肢として「Most Locations」と「South Ryukyu Islands」のと選択肢が現れ、「South Ryukyu Islands」を選ぶとタイムゾーンとして西部標準時(UTC+8)が設定されてしまうという問題が存在した。

これはこれらのOSがタイムゾーン設定の元データとして利用している「tzdata」というデータベースに誤って西部標準時に関するデータが含まれてしまい(さらに元をたどると「The International Atlas (3rd edition)」(Thomas G. Shanks、1991年)という文献において、「西部標準時が現在も石垣島等で使用されている」旨の誤った記載が行われていることが原因であった)、この誤りを正すような指摘が行われないままであったために発生したものである。

周波数標準と日本標準時 [編集]
法律に基づき、周波数標準値を設定し、標準電波を発射し、日本標準時(JST)を通報している。

NICTが運用する12台のセシウム原子時計の時刻を1日1回平均・合成することによって協定世界時UTC(NICT)を生成し、これを9時間進めたものが日本標準時JSTとなる。 なお、この協定世界時 UTC(NICT) は、国際度量衡局 (BIPM) が決定する協定世界時 (UTC)との差が±50ナノ秒以上にならないように決定される。 このようにして決定された日本標準時は、標準電波 (JJY) やNTPサーバ、電話回線を通じて供給されている(参考:国立天文台、産業技術総合研究所計量研究所)。

標準電波は、福島県田村市にある大鷹鳥谷山と、佐賀県佐賀市にある羽金山の山頂から発信されている。発信周波数は、40KHz及び60KHz。

2006年2月7日から、セシウム原子時計に加えて水素メーザー原子時計を使用することなどにより、UTCとの時刻同期精度が±50ナノ秒以内から±10ナノ秒以内に向上した。
